Brazil has announced a consolidated Technical Regulation for the mandatory requirements for jewelry. This became effective on April 1, 2021
In 2016, Brazil published INMETRO Ordinance 43/2016 to regulate lead and cadmium in jewelry.
In March 2021, the Brazilian Ministry of Economy/National Institute of Metrology, Quality and Technology (Ministério da Economia/Instituto Nacional de Metrologia, Qualidade e Tecnologia) published INMETRO Ordinance No. 123 of February 16, 2021 (Portaria Inmetro No. 123, de 16 de Fevereiro de 2021) as the approved consolidated Technical Regulation for Jewelry and costume jewelry (Consolidated Technical Regulation).
The consolidated Technical Regulation contains, inter alia, several important provisions. It:
- Emphasizes that the scope applies to jewelry and costume jewelry for adults and children – internal components of wristwatches and similar items, which are inaccessible without the use of a tool, are exempt
- Indicates that jewelry and costume jewelry must respect the lead and cadmium content requirements (see Table 1 – the concentration requirements are identical to those in INMETRO Ordinance 43/2016)
- States that jewelry and costume jewelry falling under the scope of the Consolidated Technical Regulation are subject to market surveillance activities by INMETRO
- Requires suppliers to furnish the required information within 15 days when requested by INMETRO
- Provides a definition for ‘jewelry and costume jewelry’, which includes components for the manufacture of jewelry
The consolidated Technical Regulation became effective on April 1, 2021 and repealed INMETRO Ordinance 43/2016.
