The Act lists more than 800 chemicals “known to the state to cause cancer, birth defects or other reproductive toxicity”. This list is updated at least annually. Prop 65 is a consumer “right-to-know law”. Unless exempted, businesses may not expose individuals to a listed chemical without first giving a “clear and reasonable warning” (a Prop 65 warning), nor discharge a listed chemical into sources of drinking water.
