Ukraine Strengthens Chemical Safety in Toys to Further Align with the EU

Ukraine has revised its toy safety technical regulations. The provisions will be implemented in phases, starting November 14, 2022.

In Ukraine, toys are regulated under Resolution of the Cabinet of Ministers No. 151 of February 28, 2018, approving the nation’s Technical Regulations on the Safety of Toys (Technical Regulation). The safety requirements in this Technical Regulation are similar to those in Directive 2009/48/EC in the European Union (Toy Safety Directive, TSD). Since its publication, Ukraine has amended the Technical Regulation by strengthening the migration limits for aluminum and chromium (VI), as well as restricting formaldehyde in certain toys (SafeGuardS 50/21).

On May 14, 2022, Ukraine issued Cabinet of Ministers of Ukraine Resolution No. 557 of May 7, 2022, to revise Annex 2 to its Technical Regulation. The latest amendment contains, several important provisions. It:

  • Implements the allergenic fragrances from Directives (EU) 2020/2088 and (EU) 2020/2089 to amend the TSD (SafeGuardS 188/20). It expands the number of allergenic fragrances in Table 1 to paragraph 23 of Annex 2 from 55 to 58 by adding atranol, chloroatranol and methyl heptine carbonate, and revises the number of allergenic fragrances in Table 2 to paragraph 23 of Annex 2 from 11 to 71 by adding 61 entries and deleting methyl heptine carbonate. These will become effective on November 14, 2022
  • Restricts aniline in toys that are intended for children under 36 months, or in other toys intended to be placed in the mouth

The new law will enter into force on November 14, 2022 (six months after its publication in the Official Gazette).

 Highlights of the restrictions of aniline in the new law are summarized in Table 1.
