New US CPSC Proposal Targets Battery Safety in Micromobility Devices

US Consumer Product Safety Commission (CPSC) proposes safety rule for lithium-ion batteries in micromobility products to reduce fire and injury risks.

On June 24, 2026, the CPSC published a notice of proposed rulemaking (16 CFR 1265) for lithium-ion batteries used in micromobility products and their electrical systems. The proposed rule aims to address unreasonable risks of injury and death from electric shock, fires, explosions, gas or flame expulsion, burns, overheating, smoke inhalation and thermal runaway of lithium-ion cells.

  • Personal eMobility products
  • User-replaceable battery packs
  • eBike conversion kits
  • Aftermarket battery chargers

What are the proposed requirements?

  • eBikes shall comply with all provisions of ANSI/CAN/UL 2849:2020 (Standard for Safety for Electrical Systems for eBikes) with modifications as specified in 16 CFR 1265.2(b)(1)-(9)
  • Personal eMobility products shall comply with all applicable provisions of ANSI/CAN/UL 2272:2024 (Standard for Safety for Electrical Systems for Personal E-Mobility Devices) with modifications as specified in 16 CFR 1265.3(b)(1)-(7)
  • User replaceable battery packs that are not sold with a micromobility product shall comply with all applicable provisions of ANSI/CAN/UL/ULC 2271:2023 (Standard for Safety for Batteries for Use in Light Electric Vehicle (LEV) Applications) with added or excluded requirement modifications as specified in 16 CFR 1265(4)(1)-(5).
  • Components marketed, intended or designed as part of an eBike conversion kit shall comply with the specified sections of UL 2849-20 as described in 16 CFR 1265.5(b)
  • Aftermarket battery chargers, if marketed, intended or designed to charge an eBike battery, shall comply with section 23 of UL 2849-20 and the requirements in 16 CFR 1265.2(b)(2)
  • Aftermarket battery chargers, if marketed, intended or designed to charge a personal eMobility product battery, shall comply with section 11 of UL 2272-24
  • Aftermarket battery chargers shall be provided with the following statement: “Use only with [manufacturer to insert appropriate micromobility product name and model].” The warning text must include the safety alert symbol, signal word “WARNING” and text

The rule will affect manufacturers, importers, distributors, retailers and any entity placing covered products into US commerce.

Interested parties should submit comments to the CPSC on the proposed rule by August 24, 2026. Anyone wishing to make an oral presentation must email the Office of the Secretary at cpsc-os@cpsc.gov by July 24, 2026.
