Brazil Issues Legislation for School Articles

Brazil has published an ordinance detailing the consolidated conformity assessment requirements for school articles. The ordinance entered into force on November 1, 2021.

In October 2021, Brazil’s Ministry of Economy/National Institute of Metrology, Quality and Technology (Ministério da Economia/Instituto Nacional de Metrologia, Qualidade e Tecnologia, Inmetro) published Ordinance No. 423 of October 8, 2021 (Portaria No. 423, de 8 de Outubro de 2021) approving the consolidated conformity assessment requirements for school articles (the Ordinance).

The Ordinance contains, inter alia, several important provisions. It:

  • Establishes the regulation for school articles for children under 14 years of age in the form of consolidated conformity assessment requirements (Annex I) and specifications for the conformity identification seal (Annex II) – suppliers may choose Certification Model 1b (batch testing) or 5 for conformity assessment requirements
  • Requires certified school articles to be registered with Inmetro
  • States that school articles falling under the scope of the Ordinance are subject to market surveillance activities by Inmetro and other public enforcement agencies
  • Requires suppliers to furnish the required information within 15 days when requested by Inmetro
  • Organizes the age classification of school articles into three age groups (Annex C to Annex I):
    • More than 3 and up to 6 years old
    • More than 4 and up to 6 years old
    • More than 6 and up to 14 years old
  • Provides a list of 24 product categories that are considered as falling under the scope of school articles (Annex III)
  • Requires certificates that have been issued to be revised to comply with the Ordinance in the next assessment

The Ordinance entered into force on November 1, 2021 – domestic manufacturers and importers have until December 31, 2022, to revise the conformity identification seal layout (Annex II)
