Georgia Revises Technical Regulation on Toy Safety

Georgia has made several amendments to its resolution on approving the technical regulation on toy safety. Important provisions include the addition of toy books into the scope of toys and the establishment of two lists of toy categories for compliance requirements

In January 2020, Georgia issued Resolution No. 47/2020 – a piece of legislation containing the technical regulation on toy safety and where the safety requirements are based on Directive 2009/48/EC (the European Toy Safety Directive, TSD, SafeGuardS 20/20). 

Since its publication, Georgia has amended the technical regulation on toy safety on several occasions:

  • Resolution No. 753 of December 17, 2020 (Resolution No. 753/2020) – entered into force in December 2020
  • Resolution No. 296 of June 23, 2021 (Resolution No. 296/2021) – became effective on July 1, 2021
  • Resolution No. 438 of August 31, 2021 (Resolution No. 438/2021) – became effective on September 1, 2021 and applies to provisions arising from July 1, 2021

  1. Resolution No. 753/2020
    This resolution directs the responsible Ministries to ensure that the prior notification for toy imports is approved before July 1, 2021.

  2. Resolution No. 296/2021
    This piece of legislation contains, inter alia, several important revisions. It:

    • Requires toy importers to submit an ‘advance notice of toy import’ in electronic form to the Authorities for toy categories that fall under new Annexes VII and VIII and specified in Resolution No. 438/2021
    • Directs the Authorities to suspend and prohibit toys in Annex VII that are imported from being placed on the market if a certified toy import notice is not submitted
    • Expands the scope of toys to include toy books, including:
      • Fabric books with simple pictures/drawings
      • Plasticized book with simple pictures
      • Pop up books 
      • Coloring books
      • Books with elements to touch
      • Books with simple pictures/drawings and sensory elements (touch and listen)
      • Books with stickers, simple pictures and text
      • Books that are accompanied by a toy
    • Obligations for second-hand toys, including their importers and distributors
    • Includes ordinary (standard) reading and/or textbooks with no play value for children under 14 into the scope of products that are not considered as toys

  3. Resolution No. 438/2021
    This amendment establishes toy categories in Annex VII with specified items and commodity codes (HS codes) as well as toy categories in Annex VIII. Highlights of these two Annexes are summarized in Tables 1 and 2.
