Italy Proposes to Expand Positive List of Food Contact Stainless Steels

Italy intends to adopt a draft regulation on food contact stainless steels. The Commission and other Member States have a three-month standstill period to examine the notified text.

In 2019 we informed you about Italy’s changes to its positive list of food contact stainless steels.

In July 2021, the European Commission (EC) published Notification 2021/0513/I on Italy’s intention to adopt a piece of draft legislation on food contact stainless steels (the Notification). This draft regulation, via notification 2015/1535 procedure (Directive (EU) 2015/1535), would amend Decree of the Minster of Health of March 21, 1973 on ‘Hygiene rules for packaging, containers and utensils intended to come into contact with foodstuffs or personal use products, limited to stainless steels’. 

The latest proposal contains two important changes to the requirements for food contact stainless steel. It:

  • Authorizes the addition of one more type of stainless steel to the positive list – UNI EN 10088-1:2014 Numerical designation 1.4062, also known as AISI/ASTM A240 or UNS 32202
  • Adds one specification for the concentration of certain elements in food contact stainless steels without codes or designations – Type n: short-term repeated use for kitchen and table cutting items at room or hot temperatures

According to the Notification, the three-month standstill period will end on October 29, 2021.
