China Issues Conformity Assessment System for China RoHS 2
Implementation Arrangements for the Conformity Assessment System for China RoHS 2 were issued on May 16, 2019. Products listed in the Standard Achieving Management Catalog (First Batch) manufactured or imported after November 1, 2019 shall comply with the implementation arrangement.

On May 16, 2019, China’s State Administration for Market Regulation (SAMR) and Ministry of Industry and Information Technology (MIIT) jointly announced "The Implementation Arrangements for the Conformity Assessment System for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products" (also known as the "Implementation Arrangements"). All products listed in “The Standard Achieving Management Catalog (First Batch)” manufactured and imported after November 1, 2019 shall comply with the Implementation Arrangements.
The conformity assessment system includes two routes, “Voluntary Certification for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Product” (known as "Voluntary Certification") and “Declaration of Conformity for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products” (known as "Self-Declaration”).
For products listed in the Standard Achieving Management Catalog, enterprises shall choose either the voluntary certification or self-declaration method to complete the conformity assessment on the restriction of hazardous substances. A data sharing public service platform – “Public Service Platform for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Product” – will be developed by the SAMR and MIIT. Conformity assessment information and results are managed and published by the public service platform.
Enterprises make applications on a voluntary basis. Certification bodies will assess products in accordance with the relevant standards and technical rules on the restriction of hazardous substances. Enterprises can choose the appropriate certification mode for the product in accordance with the “Voluntary Certification Implementation Rules for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products”. Certificates are issued if the enterprise passes an evaluation of the sample testing and factory inspection. All results shall be uploaded to the public service platform by the certification body within 5 working days of the issue of certificates.
Product providers (producers or authorized representatives) adopt appropriate methods independently to complete the conformity evaluation and submit the conformity information to prove product conformity with the relevant standards and technical rules on the restriction of hazardous substances. The producer or authorized representative shall submit all related information to the public service platform in accordance with the “Supplier Declaration of Conformity Rules for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products” within 30 days of a product being placed on the market.
The Implementation Arrangements introduce different conformity assessment labels for different conformity assessment methods. The use of such labels shall refer to the China’s “Administrative Measures on Green Product Labeling”.
On successful completion of the conformity assessment, products using the voluntary certification route shall use the logo shown in Figure 1, and those using the self-declaration route shall use the logo shown in Figure 2.
All levels of market regulators and administrative department of Industry and Information Technology will supervise and manage conformity assessment activities and results jointly with relevant departments. China’s SAMR, in conjunction with MIIT, shall investigate and deal with reports of any violations. In case of any non-compliance, enterprises are subject to enforcement action and relevant information shall be disclosed to the public through the National Enterprise Credit Information Publicity system and the public service platform by law.
