Ukraine has amended the expiry dates of exemptions in Annex 3 and Annex 4 to the Technical Regulations for the restriction of the use of certain hazardous substances in electrical and electronic equipment (EEE).

On May 16, 2018, the Cabinet of Ministers of Ukraine has approved Decree No. 383 [1] (in Ukrainian) on amendments to Annexes 3 and 4 to the Technical Regulation Decree No. 139 [2] (in Ukrainian) for the restriction of the use of certain hazardous substances in electrical and electronic equipment (EEE).

The expiry dates of most amended exemptions are to be set by the Cabinet of Ministers of Ukraine. While other amendments remove the previous expiry dates until they are set by the Cabinet of Ministers. Manufacturers and importers can still use such exemptions until the Cabinet of Ministers sets the relevant expiry dates. The amendments are concerned with the application scope and expiry date of the corresponding “Exemption” column and the details are as follows (non-authorized translation):

1. In the column "Field and term of application" in Annex 3:

1) Item 1(a) after the words and numbers "from July 1, 2018" to be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

2) Item 1(b) after the words and numbers "from January 1, 2018" to be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

3) Item 1(c) and 1 (d) to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

4) Item 1(e) after words and numbers "From January 1, 2018" to be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

5) Item 1(f) to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

6) In item 1(g), the words "January 1, 2018" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption "

7) Items 2(a)(1), 2(a)(2), 2(a)(3), 2(a)(4), 2(a)(5), 2(b)(3) 2(b)(4), 3(a), 3(b), 3(c), 4(a), 4(b)-I, 4(b)-II, 4(b)-III, 4(c)-I, 4 c)-II and 4(c)-III, after the words and numbers "From January 1, 2018", shall be supplemented with the words "and until the Cabinet of Ministers of Ukraine determines the term of application of this exemption "

8) Items 4(e), 4(f), 5(b), 6(a), 6(b), 6(c), 7(a), 7(c)-I and 7(c)-II to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

9) In item 7 (c)-IV, the words and numbers "January 1, 2018" to be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

10) Items 8(b), 9, 9(b), 13(a), 13(b), 15, 18(b), 21, 24, 29, 32, 34 and 37 to be introduced as "Until the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

11) In item 39, the words and numbers "January 1, 2018" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

12) In position 41, the numbers and the words "January 1, 2019" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"

2. In the column "Field and term of application" of items 37 and 41 in Annex 4, the words and numbers "January 1, 2019" should be replaced by the words "the Cabinet of Ministers of Ukraine determines the term of application of this exemption"
