Turkey Publishes Two Pieces of Legislation on Food Contact Materials and Articles

The provisions in both new laws will be implemented in phases, starting April 5, 2018.

  • Communication Number 2018/9 [1] on rules for active and intelligent materials and articles
  • Regulations on food contact materials and articles [2]. This will repeal the Turkish Food Codex Regulations on food contact materials and articles Number 28157 (Repeat 3) of December 29, 2011 [3]

The requirements for food contact active and intelligent materials under Communication Number 2018/9 are similar to those falling under Regulation (EC) 450/2009 [4] for similar food contact materials (FCM) and articles for the European Union (EU), including the use of the ‘do not eat’ symbol (Annex 1) and the information required for a declaration of conformity (DoC) (Annex 2).

The language in the Turkish Regulations on food contact materials and articles is based on Regulation (EC) 1935/2004 [5], the European Framework Regulation on food contact materials and articles. It is interesting to note that these Regulations also contain provisions for food contact paper and board, metals and alloys, as well as colorants/dyes for plastics.

Each of these two new pieces of legislation will be implemented in phases, starting April 5,2018. These include, among other compliance dates:

  • Food contact active and intelligent materials and articles that are manufactured, imported, processed or marketed before the publication of Communication Number 2018/9 will become effective on January 1, 2020
  • Food contact paper in Annex 3 under Turkish Food Codex Number 30382 of April 5, 2018 are to comply with the specifications in Table 1 of Annex II to Turkish Food Codex Number 28157 that was published on December 29, 2011. This is until December 31, 2019. From January 1, 2020, food contact paper is required to comply with Table 1 in Annex 3 under Turkish Food Codex Number 30382 of April 5, 2018
