The CPSC (Consumer Product Safety Commission) draft proposal is to clarify that infant inclined sleep products fall within the category of “durable infant or toddler products,” subject to CPSC’s consumer registration requirements.

On March 22, 2017, the U.S Consumer Product Safety Commission (CPSC) proposed a notice of rulemaking (NPR) [1] to establish a standard and include Infant Inclined Sleep Products in the list of notice of requirements (NORs) issued by the Commission. The notice of proposed rulemaking is in response to the direction under section 104(b) of the CPSIA to amend 16 CFR Part 1112 to include 16 CFR Part 1236 when the standard becomes a final rule,

The NPR would incorporate by reference the most recent voluntary standard developed by ASTM International, ASTM F3118–17, Standard consumer Safety Specification for Infant Inclined Sleep Products, with a modification to the “accessory” definition in the standard.’

ASTM F3118-17 defines an “infant inclined sleep product” as “a freestanding product, intended to provide a sleeping accommodation for an infant up to approximately 5 months of age. It is generally supported by a stationary or rocker base with one or more inclined sleep surface position(s) for the seat back that is greater than 10° and does not exceed 30° from the horizontal.”

There are many different styles of infant inclined sleep products available for infants and newborns, but the Commission determined that hammocks and other inclined sleep products for newborn should be addressed separately from bassinets and cradles.

CPSC will accept comments and recommendations until June 21, 2017.
