The European Union has recently published an amendment to the requirements for the compilation of safety data sheets (SDSs) under REACH. To avoid confusion on 2 conflicting amendments coming into force simultaneously on 1 June 2015, any SDS provided to a recipient before 1 June 2015 is allowed to be used until 31 May 2017.

On 29 May 2015, Commission Regulation (EU) 2015/830 [1] was published in the Official Journal of the European Union (OJEU). This regulation amends the requirements for the compilation of SDSs under ANNEX II of Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH).  The amendment is needed to prevent confusion resulting from two conflicting amendments to ANNEX II of REACH; both of which will come into force on 1 June 2015.  These 2 conflicting amendments are:

  • Article 59(5) under the CLP Regulation (EC) 1272/2008 on the Classification, Labelling and Packaging of Substances and Mixtures [2]
  • Regulation (EU) 453/2010 amending REACH on the requirements for the compilation of SDSs [3]

The new amendment also allows SDSs not complying with the new requirements to be used until 31 May 2017 if the SDS documents are provided to any recipient before 1 June 2015.
