New Mexico issues guidance on labeling products containing intentionally added per- and polyfluoroalkyl substances (PFAS).
In May 2026, New Mexico’s Environmental Improvement Board issued a final rule to support economic operators with the implementation of the PFAS Protection Act (Chapter 102, 2025 (HB 212)). Codified as Title 20, Chapter 13, Part 2 of the New Mexico Administrative Code (20.13.2 NMAC), the rule establishes notification, labeling and sales prohibition requirements for consumer products containing intentionally added PFAS, subject to specified exemptions. Labels must display an Erlenmeyer flask with the word ‘PFAS’ inside the flask. Products containing fluoropolymers are exempt from reporting requirements and sales prohibitions but remain subject to labeling (SafeGuards 75/26 and references therein).
The New Mexico Environmental Department issued its July 2026 guidance to help businesses meet PFAS labeling requirements for consumer products with intentionally added PFAS.

- Provides an illustrative chart with sample labels and recommended practices for products, product packaging, and related online or catalog sales materials
- Includes examples showing how labels may be used on products, product packaging and online sales pages (see Figures 1 and 2)
- Outlines labeling approaches for complex durable goods, including examples for product specifications, manuals, operation and maintenance documents, and consumer-facing product specification sheets
- Explains when another state’s PFAS label or disclaimer may be used to satisfy New Mexico’s requirements
- Sets out the conditions for labeling exemptions and waivers

When does it apply?
By January 1, 2027, manufacturers must label any consumer product containing intentionally added PFAS, unless the product is exempt. The label must also appear in online and catalog sales materials.
