Ukraine has defined specific requirements for placing food contact polyamide and melamine plastic kitchenware onto the market. The new law will apply from November 19, 2025.
On April 23, 2024, Ukraine’s Ministry of Health Protection (Міністерство охорони здоров'я України) issued Order No. 460 of March 18, 2024, (Order No. 460/2024) to establish special requirements and detailed rules for polyamide and melamine plastic kitchenware.
Order No. 460/2024 aims to establish special requirements and detailed rules for the introduction of food contact polyamide and melamine plastic kitchenware into circulation and the implementation of Commission Regulation (EU) No. 284/2011 from the European Union (EU) on specific conditions and detailed procedures for the import of food contact polyamide and melamine plastic kitchenware originating in or consigned from China and Hong Kong.
It:
- Permits these products to be placed onto the market only if the batch meets the specific migration requirements for primary aromatic amines (PAA) and formaldehyde, as governed by Order No. 2104 of December 11, 2023, on food contact plastics (see Table 1 below, SafeGuardS 35/24)
- Instructs the economic operator or his representative to submit a written declaration to the authorities that each consignment meets the specific migration limit (SML) for PAA and melamine. The written declaration is in accordance with Article 20 of the nation’s Law No. 2718-IX of November 3, 2022, ‘On materials and articles intended for contact with food’ and ‘Requirements for a written declaration’ (SafeGuardS 135/22 and 8/24 and references therein).
- Directs the economic operator or his representative to notify the authorities at the first point of introduction two working days prior to the expected date and time of arrival of the batches of food contact polyamide and melamine plastic kitchenware.
