Peru Consults Over Revised Rules for Toys and Office Supplies

Peru notifies the World Trade Organization (WTO) of draft legislation to revise the law governing toys and office supplies.

In May 2026, the WTO announced Peru’s draft regulation to amend Law No. 28376 covering toys and office supplies.

What are the key requirements of the draft regulation?

Key changes in the draft amendment include:

  • Redefining the term ‘toys’ as products designed or intended, exclusively or not, for use in play by children under 14 years of age
  • Updating the criteria for national registration (Article 16), authorization for the manufacture and importation of toys and office supplies (Articles 17, 19 and 22) and labeling (Article 36)
  • Expanding the list of toys to include dolls and action figures (Annex I)
  • Clarifying that the following are classified as office supplies: a) markers, b) decorated and colored mechanical pencils and c) decorated and colored dry ink pens (Annex III)
  • Strengthening chemical safety requirements (Annex IV), including:
    • Three sets of migration limits for 19 elements in three different material categories for toys and office supplies: a) Category I: brittle, powder-like or pliable, b) Category II: liquid or sticky and c) Category III: scrapped-off materials
    • Migration limits for N-nitrosamines and N-nitrosatable substances in five toy categories
    • Restriction of several substances in toys and/or office supplies: a) three flame retardants (TCEP, TCPP and TDCP), b) formamide, c) 1,2-benzisothiazol-3(2H)-one (BIT), d) 5-chloro-2-methyl-isothiazolin-3(2H)-one (CMIT), e) phenol, f) formaldehyde, g) aniline, h) styrene, i) bisphenol A (BPA), j) acrylonitrile, k) butadiene, l) vinyl chloride, m) benzene, n) toluene and o) six phthalates (BBP, DBP, DEHP, DIDP, DINP and DNOP)
    • Prohibition of 10 bisphenols in toys
    • Restriction of 22 aromatic amines
    • Prohibition of several substances in wood materials used in toys and office supplies
    • Prohibition of solvents in office supplies
  • Permitting the use of nickel and cobalt in specified toy applications

Who is impacted?

The proposed amendment impacts stakeholders in Peru’s toys and office supplies supply chain, including manufacturers, importers, distributors, retailers and other intermediaries.

When is the final date for comments?

Comments will be accepted until July 25, 2026.

When does it apply?

The amendment is intended to enter into force six months after publication in the official journal, El Peruano.
