An in-depth analysis of the Act, substances restricted, warnings requirement and 60-day Notice process for Hardlines and related products.

Abstract
California Proposition 65 (Prop 65), officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, lists more than 800 chemicals “known to the state to cause cancer, birth defects or other reproductive toxicity”, which is updated at least annually and affects all consumer products sold or distributed in California.
Prop 65 is a consumer “right-to-know law”. Unless exempted, businesses may not expose individuals to a listed chemical without first giving a “clear and reasonable warning” (a Prop 65 warning), nor discharge a listed chemical into sources of drinking water.
