Utah, USA, Repeals Online Law Label Requirement for Bedding, Upholstered Furniture and Quilted Clothing

Effective February 2, 2024, the state of Utah has issued an emergency rule to repeal a requirement for displaying a uniform law label for bedding, upholstered furniture and quilted clothing online (R70-101), which had been in force since January 1, 2024.

In April 2023, businesses were informed by the Utah Department of Agriculture and Food (UDAF), Division of Regulatory Services, regarding their intention to enhance surveillance and enforcement of online sales of specific products regulated by Title 4, Chapter 10 of the Utah Code and R70-101. Following a review of the policies and taking into account feedback from the furniture industry regarding the difficulties in meeting the new rule requirements, the State of Utah has opted to remove the mandate for e-commerce platforms to display a uniform law label for upholstered furniture before completing online purchases. The ruling was temporarily suspended, effective February 2, 2024, to conduct an assessment and enact required adjustments.

The emergency rule specified that the change applies specifically to bedding and upholstered products. During the suspension of online labeling requirements, the regulations for quilted clothing textile labels remain unchanged for prior or during purchase. However, no active regulatory actions for online labeling will be enforced during this period, allowing the industry time to comply with the requirements.

The temporary suspension of the rule aims to establish clear and consistent regulations concerning online labeling, demonstrating a steadfast commitment to collaboration to ensure a fair and efficient solution that protects customers. As per current information, the emergency rule change includes a 120-day review period, with any subsequent actions taken as deemed necessary.
