Brazil Revises Metal Cookware Legislation

Brazil has published an amendment to the nation’s ordinance on metal cookware. The modification can be considered effective from December 1, 2023.

In 2021, Brazil issued Ordinance 499/2021 to approve the technical regulation and conformity assessment requirements for metal cookware. This ordinance includes provisions relating to, among other things, product scope, certification model options, specifications for conformity identification seals and a list of rules and standards for demonstrating compliance. On December 1, 2023, Brazil’s Ministry of Development, Industry, Commerce and Services and National Institute of Metrology, Quality and Technology issued an amendment  to each ‘note’ under Sections 4.1.1.2 and 4.2.1.1 in Annex I to Ordinance 499/2021.

Each of the two revised ‘Notes’ clarifies that Ordinance 499/2021 is not limited to the metal materials specified in these sections. If there are metal materials that are not specified, they are obliged to meet their respective technical standards and migration element requirements according to the Brazilian Health Regulatory Agency (Agência Nacional de Vigilância Sanitária, Anvisa) Resolutions.
