Rhode Island, USA, Revises Consumer PFAS Ban Act of 2024

Rhode Island updates enforcement provisions concerning per- and polyfluoroalkyl substances (PFAS) in products.

In 2024, Rhode Island enacted the Consumer PFAS Ban Act of 2024 (the Act, S2152/H7356), codified as Chapter 23-18.18 of the state’s general laws, to regulate the use of intentionally added PFAS in specified categories of consumer products. In 2025, the state expanded the scope of regulated products to include firefighting personal protective equipment (SafeGuardS 106/24 and 87/25).

On June 19, 2026, the governor of Rhode Island signed H 7734 (companion S 2799) into law, amending the Act to clarify and strengthen enforcement provisions.

What does this regulation require?

Key updates in the amendment include:

  • Specifying that the Department of Environmental Management (DEM) must send notices regarding subsections (c) and (d) of section 232-18.18-4 ‘Prohibition on use of PFAS’ by certified mail
  • Authorizing the DEM to grant exemptions for certain products or categories of products, providing the following conditions are met:
    • The product offers environmental benefits and protects public health or safety
    • No alternative exists to replace PFAS in the product
    • No comparable non-PFAS added product is available at a reasonable cost
  • Directing the DEM to consult neighboring states and regional organizations for consistency before granting the exemption mentioned above.
  • Clarifying that exemptions are renewable, and each renewal period must not exceed five years
