Brazil’s INMETRO implemented measures to prohibit certain toys containing 1,4-butanediol. Such toys not containing this substance must undergo mandatory testing and certification. The new law took effect on 8 March, 2016.

On 8 March, 2016, the Brazilian National Institute of Metrology, Quality and Technology (Instituto Nacional de Metrologia, Qualidade E Technologia, INMETRO) published Ordinance No. 99 of 7 March, 2016 in the Official Journal of the Federal Government of Brazil [Portaria No. 99, de 7 de Março de 2016, Diário Oficial da União (DOU)]. [1] This Ordinance amends the Technical Regulation on Toy Safety and contains a number of important changes for certain toys containing or not containing 1,4-butanediol, including:

  • Aqua Dots, Bindeez and similar toys containing 1,4-butanediol

    1. Prohibited from being certified and sold in Brazil
    2. Such toys on the market are to be withdrawn immediately        
  • Aqua Dots, Bindeez and similar toys not containing 1,4-butanediol

    1. Allowed to be certified and sold in Brazil
    2. Such toys must contain a warning indicating that these are not intended for children under 3 years of age

    3. Submit technical report containing test method and a statement declaring that such toys do not contain 1,4-butanediol to a Certification Body for Certification.        

1, 4-Butanediol is a prodrug which can be metabolized into gamma-hydroxybutyric acid (GHB), a sedative that can cause a loss of consciousness, nausea, sweating, hallucinations and other side effects.

This Ordinance took effect on the date of publication in the DOU which is 8 March, 2016.
